Account Registration
Eligibility and Legal Use
- Minimum age: You may only open an Account if you are at least 18 years old and have reached the legal age for online gambling in your jurisdiction. You must not allow any person under 18 (or the applicable legal age) to access your Account.
- Legality in your jurisdiction: You are solely responsible for ensuring that your use of the Website is lawful under the laws applicable to you, including the Interactive Gambling Act 2001 (Cth) and any state/territory laws in Australia. You must not use the Website where such use is unlawful or where you are physically located in a Restricted Jurisdiction.
- Separate EU site: The N1 Casino website operated under Malta Gaming Authority licence MGA/B2C/203/2011 for European players is not available to Australian players. Accessing that site by VPN, proxy or any technical circumvention is prohibited and may result in confiscation of funds and account closure.
Account Creation and Verification
- Registration details: To create an Account you must provide accurate, complete and up-to-date information, including your full name, date of birth, residential address, email address, phone number (if requested) and country of residence. You confirm that you act on your own behalf and not for any third party.
- Email verification: The Operator may require email verification by sending a confirmation link or code. Your Account may remain limited until verification is completed.
- KYC and identity checks: At registration, before withdrawals or at any time thereafter, the Operator may request KYC documents, including but not limited to:
- Government-issued photo ID (passport, driver's licence or national ID card);
- Proof of address (utility bill, bank statement, government correspondence not older than 3 months);
- Proof of ownership of payment methods (masked card copy, bank statement, e-wallet screenshot, crypto wallet proof).
Account Integrity and Security
- Single account: You may only hold one Account on the Website. Creation or use of multiple Accounts, including under different names, emails or IP addresses, is prohibited and may lead to closure of all related Accounts and confiscation of Bonuses and winnings.
- Credentials: You must keep your username, password and other security credentials confidential. You are responsible for all activity on your Account, whether or not authorised by you. You must notify the Operator immediately if you suspect any unauthorised access.
- Prohibited tools: You must not use VPNs, proxies, bots, automated software, screen scraping tools or any device intended to conceal your location or to gain an unfair advantage. If the Operator reasonably believes such tools are used, it may suspend or terminate your Account and void bets.
- Accuracy of data: You agree to keep your registration information up to date. Providing false, misleading or incomplete information may result in Account closure, voiding of bets and retention of funds where required for AML or regulatory reasons.
Betting & Gameplay Rules
Placing Bets and Game Participation
- Availability of Games: All bets are placed exclusively through the Website's interface. The Operator may add, remove or modify Games at any time, including due to regulatory or provider requirements.
- Bet acceptance: A bet is deemed accepted when it is registered on the Operator's server and appears in your betting or game history. If a discrepancy arises between your screen and the Operator's records, the Operator's records will prevail, subject to independent game provider logs where applicable.
- Minimum and maximum stakes: Each Game has minimum and maximum bet limits as shown in the game rules or on-screen interface. You are responsible for checking these limits before placing a bet. The Operator may adjust limits or impose individual limits at its discretion.
- Currency and rounding: Bets are placed in the currency selected in your Account (where available). Minor discrepancies due to rounding will be handled in favour of accurate mathematical outcome; such discrepancies do not give rise to any additional claim.
Game Results, Errors and Cancellations
- Game outcome: Game results are determined by certified random number generators (RNGs) or by live dealer outcomes, as applicable. The Operator ensures that Games are supplied by licensed providers and are intended to be fair and random.
- Misuse and obvious errors: If a Game or bet is settled based on an obvious error (including technical malfunction, incorrect odds, misconfiguration, or a bug), the Operator may declare the bet void, reverse the settlement and restore your balance to the state before the erroneous bet. Winnings derived from such errors are invalid.
- Interrupted games: If your connection drops during a Game, the result may still be completed by the game server. The final result recorded on the game server will apply. In the event of total game failure, the Operator may cancel the bet and refund the stake.
- Cancellation or modification by player: Once a bet has been confirmed, you cannot cancel or modify it except where the particular Game rules explicitly allow such action.
Conduct in Live Casino and Chat
- Respectful behaviour: You must act respectfully towards dealers, other players and staff. Abusive, racist, sexist, threatening, defamatory or otherwise offensive language or behaviour in live casino chats or messages is strictly prohibited and may result in chat bans, Account suspension or closure.
- No collusion or fraud: You must not engage in collusion, advantage play techniques exploiting obvious errors, chip dumping, syndicate betting or any form of fraudulent or criminal activity. The Operator may investigate suspicious patterns, report them to relevant authorities and freeze funds during investigations.
- Recording: Unauthorised recording, rebroadcasting or public sharing of live dealer streams or other Website content is prohibited and may violate intellectual property and privacy rights.
Bonus Terms
Bonus Activation and General Conditions
- Offer-specific rules: Each Bonus, promotion, tournament or loyalty reward is subject to specific terms displayed on the Website at the time of the offer ("Promotion Terms"). These Terms apply in addition to the Promotion Terms. In case of conflict, Promotion Terms prevail.
- Eligibility: Bonuses are intended for recreational players only. The Operator may restrict or exclude individual players from receiving Bonuses at its discretion, including for suspected bonus abuse, use of multiple Accounts or professional gambling patterns.
- Activation: Some Bonuses require a bonus code, minimum deposit or explicit opt-in. You are responsible for entering any bonus code correctly and checking that the Bonus has been credited before playing.
Wagering Requirements and Time Limits
- Standard wagering: Unless otherwise specified in the Promotion Terms, Bonuses and winnings derived from Bonuses are subject to wagering requirements before they may be withdrawn. The applicable wagering multiplier (for example, 40 times the bonus amount) will be stated in the specific promotion.
- Timeframe: Bonuses are typically subject to a limited validity period (for example, 7 days from activation) as stated in the Promotion Terms. Any remaining Bonus funds and associated winnings may be forfeited after expiry.
- Contribution of Games: Not all Games contribute equally to wagering requirements. Slots usually contribute 100%, while table games, live casino games and some other Games may contribute less or not at all. The Website or Promotion Terms will display game contribution percentages.
- Max bet with active Bonus: When a Bonus is active, a maximum bet per spin/round may apply (for example, the equivalent of a specific amount in your Account currency). Bets above this limit while wagering a Bonus may be considered irregular play and may lead to confiscation of the Bonus and associated winnings.
Prohibited Actions and Bonus Abuse
- Irregular play: The following may be treated as bonus abuse or irregular play:
- Placing very low-risk bets or hedging bets on opposite outcomes to clear wagering;
- Using bonus funds to progress through game features (e.g., collecting bonus rounds) and then completing those features with real money bets;
- Deliberately delaying game rounds, free spins or bonus features until after wagering requirements are met;
- Creating multiple Accounts or colluding with other players to claim the same offer multiple times.
- Combination of promotions: Unless explicitly allowed, Bonuses cannot be combined. Having more than one active Bonus at the same time may not be permitted. Loyalty rewards, cashback and tournaments may have separate accumulation and wagering rules.
- Withdrawal before wagering: If you request a withdrawal before completing the applicable wagering requirements, the Operator may cancel the active Bonus and deduct Bonus funds and associated winnings from your balance, paying out only your remaining Real Money Balance.
Payments & Withdrawals
Deposits
- Payment methods: Deposits may be made using bank cards, e-wallets, bank transfers, prepaid vouchers and selected cryptocurrencies, to the extent available in your jurisdiction and displayed in the Website's cashier. Payment processing for certain methods may be handled by Friolion Limited (Cyprus) or other authorised processors.
- Limits and fees: Minimum and maximum deposit limits per transaction may apply and will be shown in the cashier section. The Operator does not charge deposit fees; however, your bank, card issuer, e-wallet or crypto provider may apply fees or exchange charges, for which the Operator is not responsible.
- Ownership of payment method: You may only deposit using payment instruments held in your own name. Using third-party cards, accounts or wallets is prohibited and may lead to reversal of transactions, Account suspension and reporting to relevant authorities.
- Chargebacks: You agree not to request chargebacks or transaction reversals without prior discussion with the Operator. Unjustified chargebacks are considered breach of these Terms and may result in Account closure, reporting to payment providers and collection of any outstanding debts.
Withdrawals
- Withdrawal requests: You may request withdrawal of funds from your Real Money Balance via the cashier section. Bonuses and funds subject to wagering requirements or other conditions may not be withdrawn until such conditions are fulfilled.
- Verification: The Operator may require KYC verification before processing withdrawals, including additional documentation beyond that supplied at registration. Until satisfactory verification is completed, withdrawal requests may be pending or declined.
- Processing times: The Operator aims to review withdrawal requests within a reasonable period (for example, within 0 - 3 Business Days). Actual receipt of funds depends on the payment method and third-party providers and may take longer. The Operator is not liable for delays caused by banks, e-wallets, crypto networks or other intermediaries.
- Payment method for withdrawals: Wherever possible, withdrawals will be processed using the same method and to the same account or wallet used for deposit, in line with AML and security requirements. The Operator may require withdrawal via bank transfer or alternative method if the original method does not support payouts.
- Limits and instalments: The Operator may impose minimum and maximum withdrawal limits per transaction, day, week or month. If your requested withdrawal exceeds the applicable limit, it may be paid in instalments. Current limits are shown in the cashier section.
Refunds, Reversals and Account Balances
- No refund for completed bets: Bets that have been correctly placed and settled in accordance with these Terms and the Game rules are non-refundable. The Operator does not provide refunds for losses caused by your gambling decisions.
- Mistaken deposits: If you deposit an amount by mistake, you should contact support promptly. Subject to AML checks and confirmation that the funds have not been used for betting, the Operator may at its discretion refund such amounts via the same method, where possible.
- Inactive or closed Accounts: On Account closure (other than for fraud, AML breaches or other serious violations), any remaining Real Money Balance will be paid out to you, subject to verification checks and applicable withdrawal limits. Bonus funds and unfinished Bonuses will be cancelled on closure.
Limitation of Liability
Operator's Obligations
- Fairness and integrity: The Operator undertakes to offer Games from reputable providers using certified RNGs or properly supervised live dealer setups and to ensure that betting outcomes are determined fairly and in accordance with the applicable Game rules.
- Accuracy of information: The Operator strives to ensure that information on the Website, including balances, bet history and promotion details, is accurate. However, occasional errors or omissions may occur and will be corrected as soon as reasonably practicable.
- Security: The Operator uses reasonable technical and organisational measures to protect your personal and financial data. Despite these measures, no system is completely secure, and you acknowledge the inherent risks of internet use.
Exclusions and Limitations
- No guarantee of uninterrupted service: The Website and Games are provided on an "as is" and "as available" basis. The Operator does not warrant that access will be uninterrupted, error-free, free of viruses or compatible with all devices, operating systems or browsers.
- Technical failures: The Operator is not liable for any loss, damage or inconvenience arising from technical failures, network interruptions, ISP blocking (including any blocking or disruption ordered or facilitated by the Australian Communications and Media Authority), device malfunctions or third-party service interruptions.
- Indirect and consequential loss: To the maximum extent permitted by law, the Operator is not liable for any indirect, incidental, special, punitive or consequential damages, loss of profits, revenue, data, goodwill or opportunity arising from your use of the Website or inability to use it.
- Cap on liability: Subject to any non-excludable statutory rights (including, where applicable, rights under the Australian Consumer Law), the Operator's total aggregate liability to you in relation to a particular bet or Game shall not exceed the amount of the stake involved in that bet or Game, or, in the case of an error in crediting your Account, the amount that was incorrectly credited.
- Statutory rights: Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. If you are an Australian resident and mandatory provisions of the Australian Consumer Law apply to our services, nothing in these Terms will restrict your non-excludable rights under that law.
Intellectual Property Rights
Ownership
- Website content: All trademarks, service marks, trade names, logos, domain names, designs, graphics, text, software, underlying source code, databases, audio, video, animations and other materials appearing on the Website ("Content") are owned by the Operator, its affiliates, licensors or service providers.
- Limited licence: You are granted a limited, non-exclusive, non-transferable and revocable licence to access and use the Website and Content for personal, non-commercial entertainment purposes only, in accordance with these Terms.
Restrictions
- No copying or distribution: You must not copy, reproduce, modify, adapt, translate, distribute, sell, license, publicly display, publish, frame, transmit or otherwise exploit any part of the Website or Content without the prior written consent of the Operator or the relevant rights holder.
- No reverse engineering: You must not reverse engineer, decompile, disassemble or otherwise attempt to obtain the source code of the Website, Games or software, except to the extent permitted by mandatory law.
- Third-party rights: Games and software may be provided by third-party suppliers. Any use of their content is subject to the terms imposed by such suppliers, and you must not infringe their intellectual property rights.
Privacy & Data Protection
- Privacy Policy: The Operator processes your personal data in accordance with its Privacy Policy, as amended from time to time and available on the Website. By using the Website and creating an Account, you acknowledge that you have read and understood the Privacy Policy and agree to the processing of your data as described.
- Data uses: Personal data may be used for verifying identity, processing payments, complying with legal and regulatory obligations (including AML/CFT requirements), managing your Account, personalising offers, and ensuring the security and integrity of the Website.
- Cookies and tracking: The Website may use cookies and similar technologies. Details of such technologies and your choices are set out in the Privacy Policy and/or Cookie Policy.
Changes to Terms
- Right to amend: The Operator may modify these Terms at any time to reflect changes in legal or regulatory requirements, technical developments, product changes, or business needs.
- Notification: Material changes to these Terms will be notified by one or more of the following methods:
- Posting the updated Terms on the Website with a revised "effective date"; and/or
- Displaying a prominent banner, pop-up or in-account message; and/or
- Sending an email to the address registered in your Account.
- Acceptance of changes: Continued use of the Website after the effective date of the updated Terms will constitute your acceptance of those changes. If you do not agree with the amended Terms, you must stop using the Website and may request closure of your Account.
- Version control: It is your responsibility to review the Terms regularly. The Operator may keep an archive of previous versions available upon request or via the Website.
Termination & Suspension
Termination by the Operator
- Grounds for action: The Operator may suspend, restrict or close your Account, and withhold or confiscate funds where lawful, if:
- You breach or are reasonably suspected of breaching these Terms or Promotion Terms;
- You provide false or misleading information or fail KYC, AML or affordability checks;
- There is suspicion of fraud, money laundering, terrorist financing, chargebacks, collusion or other criminal or unlawful activity;
- You use the Website from a Restricted Jurisdiction or via VPN/proxy to circumvent geo-blocks;
- Requested documents are not supplied, are incomplete or are not satisfactory.
- Consequences: In case of serious breach or unlawful activity, Bonuses and winnings may be voided, and Real Money Balances may be retained or reported to authorities where required by law. In less serious cases, the Operator may allow withdrawal of remaining Real Money Balance after necessary checks.
- Notification: Where lawful and practicable, the Operator will notify you of the suspension or closure and the reasons, using your registered email address or in-account message.
Termination by the Player and Self-Exclusion
- Voluntary closure: You may request closure of your Account at any time by contacting support via the methods described on the Website. After closure, you will no longer be able to access the Account. Any remaining Real Money Balance will be paid out subject to verification checks and applicable withdrawal limits.
- Responsible gambling: If you experience problems with gambling, you are strongly encouraged to use the Website's responsible gambling tools, including deposit limits, loss limits, session limits and self-exclusion settings, and to seek help from recognised support organisations.
- Effect of self-exclusion: During a self-exclusion period, you must not attempt to open new Accounts or circumvent the exclusion. The Operator will, within reasonable technical limits, prevent your participation in real-money gambling on the Website during the exclusion period.
Governing Law & Jurisdiction
- Governing law: These Terms and your relationship with the Operator are governed by the laws of Curaçao, excluding any conflict-of-law rules that would result in the application of another law. To the extent mandatory consumer protection or gambling laws of your country of residence apply and cannot be excluded, such laws may afford you additional rights.
- Offshore nature and Australian law: The Website is operated from Curaçao and is not licensed by the Australian Communications and Media Authority or any Australian state or territory regulator. Australian authorities may take enforcement action, including ordering Australian ISPs to block access to offshore gambling websites. By using the Website, you acknowledge these enforcement practices and your obligation to comply with applicable Australian law.
- Internal complaints: If you have a complaint, you should first contact the Operator's customer support via the channels provided on the Website. You should provide full details of your complaint, including relevant screenshots and timestamps.
- External dispute resolution: If, after exhausting the internal complaints process, you are not satisfied with the outcome, you may escalate a regulatory complaint to the licence holder's complaints address, currently [email protected], referencing licence number 8048/JAZ2020-013. The independent assessment process is administered under the Curaçao licensing framework.
- Court jurisdiction: Subject to any applicable alternative dispute resolution mechanisms and your non-excludable statutory rights, any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Curaçao.
